Universal Rosa Cleaning llc – TERMS OF SERVICE & LIABILITY WAIVER

This Agreement is entered into between [Universal Rosa Cleaning llc] (“Company”, “I”, “Me”) and the undersigned homeowner or authorized property manager (“Client”, “You”) for preventative residential maintenance services.

1. Scope of Service & Strict Boundaries

Client agrees that Company is a basic preventative maintenance and inspection provider. Company is not a licensed HVAC contractor, master plumber, or electrician. Services are strictly limited to the following 7 core items, subject to these exact operational boundaries:

  • Light Bulb Replacements: Limited to a maximum of twelve (12) bulbs per visit, at a maximum ceiling height of ten (10) feet. Company will not service vaulted ceilings, chandeliers, or areas requiring specialized heavy extension ladders.

  • Smoke Detector Battery Swaps: Limited to accessible detectors at a maximum height of ten (10) feet.

  • Water Heater Inspection: This is a visual and safety check only. Company will not drain, flush, or turn plumbing valves, nor perform mechanical or electrical repairs on the water heater.

  • Dryer Vent Safety Check: This is a visual airflow and duct check only. Company will not run mechanical cleaning brushes or rods inside the wall cavity, nor repair damaged or brittle ductwork.

  • AC Filter Replacement: Company will replace client-provided filters only. No deep coil cleaning, electrical diagnostic work, or mechanical repairs will be performed.

  • Garage Door Lubrication: Limited to the application of spray lubricant to hinges, rollers, and visible tracks. Company will not adjust or tension heavy garage door springs, cables, or opener motors.

  • Refrigerator Water Filter Replacement: Company will replace client-provided filters. If an existing water line is brittle, leaking, or improperly installed prior to arrival, Company reserves the right to refuse service on this item to prevent property damage.

2. Materials & "Bring Your Own Parts" Policy

Client agrees to provide all consumable materials (including but not limited to: air filters, refrigerator filters, batteries, and light bulbs) unless explicitly agreed upon in writing beforehand. If Company agrees to supply parts, Client will be billed the exact retail store receipt price with zero markup. Company offers no warranties, express or implied, on any materials or parts manufactured by third parties.

3. Limitation of Liability & Pre-Existing Conditions

  • Pre-Existing Damage: Company is not liable for any pre-existing damage, wear-and-tear, or system failures hidden within the property. This includes brittle plumbing valves, degraded drywall, old appliance water lines, or malfunctioning electrical sockets.

  • Inspection Disclaimer: Any inspection notes, verbal recommendations, or digital status reports provided by Company are for informational, preventative purposes only. They do not constitute an official home inspection or guarantee against future system failures. Client is solely responsible for hiring licensed specialists (plumbing, HVAC, electrical) to address serious issues.

  • Damage Cap: In the unlikely event that Company causes accidental damage to the property during the execution of services, Company’s total liability shall be strictly limited to the repair or replacement of the specific damaged item, up to a maximum cap equal to the total annual fee paid by the Client, or covered under the Company's active liability insurance policy.

4. Subscription Billing, Cancellations, & Prorated Refunds

  • Billing: Subscriptions are billed automatically on a recurring monthly or annual basis via card-on-file.

  • Cancellations: Client may cancel the subscription at any time through their online portal or by providing written notice.

  • Refunds: If an annual subscription is cancelled early, Company will calculate a prorated refund by deducting the full standard retail value of any completed home maintenance visits ($150 per visit) from the total initial annual fee paid.

5. Safe Work Environment & Pet Policy

Client agrees to provide a safe, accessible, and hazard-free work environment. All pets must be safely secured away from work zones, ladders, and tools during the entire duration of the service visit. Company reserves the right to refuse service or leave the property immediately if unsafe conditions, aggressive pets, or hostile environments are encountered, without a refund for that scheduled visit.

6. Governing Law

This agreement shall be governed by, construed, and enforced in accordance with the laws of the State of Florida. Any legal disputes or actions arising from this agreement shall be handled exclusively in Lee County, Florida.

By signing below, or by completing your online subscription registration and payment, you acknowledge that you have read, understood, and agree to all terms, conditions, and liability limitations outlined above.
